These Terms & Conditions (the “Terms”) govern your access to and use of https://alcoholtester.com (the “Website”) and any purchase, quotation request, account, communication, or other transaction made through the Website. The Website is operated by Shenzhen Taoyue Electronic Technology Co., Ltd. (深圳市韬越电子科技有限公司), trading through AlcoholTester (“AlcoholTester,” “we,” “us,” or “our”).

By accessing the Website, creating an account, placing an order, requesting a quotation, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

2. Eligibility and Authority

The Website, products, and services are intended for persons who are at least 18 years old. By using the Website, you confirm that you are at least 18 and legally capable of entering into a binding agreement.

If you use the Website or place an order on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms. In that case, “you” also refers to the organization.

3. Products and Website Information

We supply breathalyzers, gas detectors, digital scales, mouthpieces, accessories, and related OEM or private-label products. Product availability, specifications, colors, packaging, included accessories, measurement ranges, accuracy, response times, calibration intervals, certifications, and other features may differ by model and may be updated from time to time.

We make reasonable efforts to present product descriptions, images, specifications, prices, and availability accurately. However, website images are illustrative, screen colors may differ from the physical product, and minor production variations may occur. Information on the Website does not replace the product manual, quotation, specification sheet, order confirmation, or applicable certification documents.

We may correct errors, update information, modify products, or discontinue products without prior notice. If a material error affects an accepted order, we will contact you and offer an appropriate solution, which may include reconfirmation, replacement, or refund.

4. Orders and Order Acceptance

Submitting an order or payment does not automatically mean that we have accepted the order. An order is accepted when we issue a written order confirmation, confirm the transaction by email or other agreed communication, or dispatch the goods.

You are responsible for checking the product model, quantity, specifications, voltage or power requirements, measurement units, delivery address, contact information, and customization details before confirming an order.

We may reject or cancel an order before dispatch for reasons including product unavailability, incorrect pricing or product information, suspected fraud, payment failure, export or sanctions restrictions, delivery limitations, or inability to verify the customer or transaction. If we cancel a paid order for reasons not caused by you, we will return the applicable payment using the original payment method or another mutually agreed method.

5. Prices, Quotations, Taxes and Charges

Prices are shown in the currency displayed on the Website, quotation, invoice, or order confirmation. Website prices may change without notice, but a price change will not normally affect an order already accepted by us.

Shipping is quoted separately. We do not provide a fixed or automatic free-shipping offer unless it is expressly stated in a quotation, promotion, invoice, or order confirmation.

Unless expressly included in writing, prices exclude shipping, insurance, customs duties, import taxes, value-added tax, brokerage fees, destination charges, bank fees, currency-conversion charges, and other government or third-party charges. Responsibility for these charges and the applicable delivery term will be stated in the quotation or order confirmation. If they are not stated as included, they are the customer’s responsibility to the extent permitted by law.

Quotations are valid only for the period and quantities stated in the quotation. Changes to quantity, specifications, artwork, packaging, exchange rates, material costs, shipping conditions, or destination may require a revised quotation.

6. Payment

Available payment methods may include PayPal, Alipay, T/T bank transfer, and XTransfer. The available methods for a particular order may depend on the customer’s location, order value, product type, and quotation.

Orders will be processed after we receive cleared payment or the deposit specified in the applicable quotation or invoice. You are responsible for providing accurate payment information and paying any bank, intermediary, conversion, or transfer charges allocated to you in the quotation or by your payment provider.

Payments processed by third-party payment providers are also subject to those providers’ terms and privacy policies. We do not control a payment provider’s approval, security review, processing time, currency conversion, or account restrictions.

7. Processing, Shipping and Delivery

Products are dispatched from Shenzhen, China, unless otherwise stated. Available shipping methods may include DHL, FedEx, UPS, air freight, sea freight, freight forwarders, and other agreed logistics providers.

Our general processing and transit estimates are:

  • Standard in-stock products: normally dispatched within 2 business days after payment and order confirmation.
  • Customized or OEM products: normally dispatched within approximately 15 business days after payment requirements, specifications, artwork, packaging, and production details have been confirmed.
  • Courier or express delivery: approximately 15 days after dispatch.
  • Air freight: approximately 7 days after dispatch.
  • Sea freight: approximately 25 days after dispatch.

These periods are estimates, not guaranteed delivery dates. Production schedules, customs clearance, inspections, flight or vessel availability, carrier capacity, public holidays, weather, force majeure events, destination restrictions, and incomplete customer information may cause delays.

You must provide a complete and accurate delivery address, recipient name, telephone number, email address, customs information, and any other information required for delivery. Additional costs caused by an incorrect address, refusal to accept delivery, failed delivery attempts, missing import documents, or unpaid destination charges may be charged to you.

Risk of loss, transfer of title, customs responsibility, and delivery obligations are determined by the delivery term stated in the quotation, invoice, order confirmation, or applicable mandatory law. Please inspect the shipment promptly and contact us as soon as possible if goods are missing, damaged, or materially different from the confirmed order.

8. Order Changes and Cancellations

A standard-product order may be changed or cancelled only before dispatch and only if we confirm the change or cancellation in writing. Once an order has been dispatched, it cannot be cancelled and must be handled under the Returns and Exchanges section below.

Customized, OEM, private-label, logo-printing, custom-packaging, or specification-based orders cannot be cancelled or refunded after the design, artwork, sample, specification, or production order has been approved and production or material preparation has begun. Any applicable deposit may be non-refundable after that point.

This restriction does not remove our responsibility for verified manufacturing defects or goods that materially fail to meet the written, confirmed specifications. Those matters will be handled through repair, replacement, rework, credit, refund, or another mutually agreed solution, as appropriate.

9. Returns and Exchanges

For eligible standard products, you may request a return or exchange within 30 days after delivery. Before returning a product, contact support@alcoholtester.com and obtain our return instructions.

To qualify for a return or exchange, the product must be undamaged, unused except for reasonable inspection, and returned with complete original packaging, accessories, manuals, labels, and other included items. We may reject or reduce a refund for products that are damaged, incomplete, used beyond reasonable inspection, or returned without authorization.

Customers are responsible for return shipping costs and for the product until it is received by us, unless the return results from our shipping error, a verified manufacturing defect, or applicable law requires otherwise. Original shipping charges, customs duties, import taxes, bank charges, and similar third-party costs are normally non-refundable.

For health and hygiene reasons, opened or used mouthpieces and other sealed products that contact the mouth cannot be returned unless they are defective or applicable law requires the return. Customized and private-label products are not returnable except for verified defects or material non-conformity with the approved written specifications.

Approved refunds are issued after the returned goods have been received and inspected. Processing times may vary depending on the payment method and financial institution.

10. Limited Product Warranty

Unless a product page, quotation, invoice, or written warranty states otherwise, our products include a 365-day limited warranty beginning on the delivery date. The warranty covers verified manufacturing defects under normal, intended use.

The warranty does not cover normal wear, consumable items, mouthpieces, routine calibration or maintenance, depleted batteries, accidental damage, misuse, improper storage, exposure to unsuitable temperatures or chemicals, liquid ingress, unauthorized repair or modification, failure to follow the manual, or use outside the product’s stated specifications.

To request warranty service, contact us with the order number, product model, serial number if available, a description of the issue, and clear photos or videos where reasonably requested. After assessment, the available remedy may include troubleshooting, repair, replacement, spare parts, rework, credit, or refund. Nothing in this warranty limits rights that cannot lawfully be excluded.

11. Product Use, Measurement and Safety

You must read and follow the product manual, safety instructions, calibration requirements, operating limits, and applicable local laws before using any product.

Breathalyzer readings can be affected by calibration status, sensor type, test timing, environmental conditions, residual mouth alcohol, user technique, and other factors. Unless a specific product is expressly certified and approved for an evidential purpose, results are intended for screening or informational use and should not be treated as conclusive legal or medical evidence. Never use a reading as the sole basis for deciding whether it is safe or lawful to drive, operate machinery, or perform a safety-sensitive activity.

Gas detectors should be selected, installed, calibrated, tested, and maintained for the intended gas and environment. Unless expressly approved for that purpose, a product should not be treated as the sole protection in a workplace, confined space, emergency, life-safety, or regulatory-compliance system.

Digital scales must be used within their rated capacity and resolution. Unless expressly certified for a specific purpose, they are not intended for medical diagnosis, regulated laboratory analysis, legal-for-trade transactions, or other controlled applications.

You are responsible for determining whether a product, certification, unit of measurement, labeling, manual, and intended use comply with the laws and standards of your country or market.

12. OEM, Private Label and Customer Materials

OEM and private-label requirements, minimum order quantities, pricing, samples, artwork, tooling, packaging, testing, certifications, production schedules, tolerances, and delivery terms are governed by the applicable quotation, specification sheet, sample approval, invoice, or written agreement.

You confirm that you own or have permission to use every trademark, logo, design, image, text, instruction, packaging element, certification mark, and other material supplied to us. You authorize us and our production partners to use those materials only as reasonably necessary to prepare samples, manufacture, package, inspect, and deliver your order.

You are responsible for reviewing and approving artwork, spelling, colors, measurements, specifications, packaging, labels, warnings, and samples before production. We are not responsible for errors contained in customer-approved materials unless we failed to follow the approved version.

Unless we expressly agree otherwise in writing, the customer is responsible for product registration, import approval, local-language labeling, market-specific warnings, and regulatory compliance in the destination market.

13. Accounts and Account Security

You may be permitted to purchase as a guest or create an account. Account information must be accurate and kept up to date. You are responsible for protecting your password and for activity conducted through your account.

Notify us promptly if you suspect unauthorized access. We may suspend or terminate an account where reasonably necessary to protect the Website, users, transactions, or our legal rights.

14. Reviews, Comments and Uploaded Content

You may be allowed to submit reviews, comments, images, documents, artwork, or other content. You must not submit content that is unlawful, misleading, defamatory, infringing, abusive, malicious, confidential without authorization, or harmful to the Website or another person.

You retain ownership of your content. For content intended for public display, such as a product review, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute it in connection with the Website and our business. This license ends when the content is deleted, except where continued retention is technically necessary or legally permitted.

We may moderate, reject, or remove content that violates these Terms or applicable law.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, punitive, or consequential loss, including loss of profit, revenue, business opportunity, data, goodwill, or anticipated savings, arising from the Website, a product, shipping delay, third-party service, or these Terms.

To the maximum extent permitted by law, our total liability relating to a particular order or product will not exceed the amount you paid us for that order or product. These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence where liability cannot be excluded, or any other liability that applicable law does not permit us to limit.

20. Indemnification by Business Customers

If you purchase for business, resale, OEM, or private-label purposes, you agree, to the extent permitted by law, to indemnify us against third-party claims and reasonable costs arising from materials or instructions you supplied, your product claims or marketing, your unauthorized modification or use of a product, or your violation of applicable import, labeling, advertising, intellectual-property, or product-compliance requirements.

21. Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, civil disturbance, government action, sanctions, export or import restrictions, customs delays, labor disputes, power or network failures, material shortages, factory interruption, carrier disruption, port congestion, or transportation cancellation. We will use reasonable efforts to notify affected customers and resume performance when practicable.

22. Governing Law and Disputes

These Terms and any non-contractual dispute arising from them are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles.

Any dispute that cannot be resolved through good-faith discussion will be submitted to a people’s court with competent jurisdiction in Shenzhen, Guangdong, China. If mandatory consumer law gives you rights or a forum that cannot be waived, those mandatory rights and rules remain unaffected.

23. Severability, Waiver and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of that provision.

These Terms, together with the applicable quotation, invoice, order confirmation, product specification, Privacy Policy, Cookie Policy, Shipping page, and any written agreement accepted by both parties, form the agreement relating to your use of the Website and purchase. If documents conflict, a specifically negotiated written order agreement or quotation will take priority for that order.

24. Changes to These Terms

We may update these Terms to reflect changes to our products, services, Website, technology, or legal obligations. The updated version will be posted on this page with a revised “Last updated” date. Changes apply prospectively unless applicable law requires otherwise.
